Terms of service
Last updated 24 October 2026
These terms are the agreement between your business and TableDesk when you use our software. They are written to be read, not skimmed past. If something is unclear, ask us before you sign up.
1. The agreement
These terms are between you and TableDesk (“TableDesk”, “we”, “us”). By creating an account, by using TableDesk, or by using a TableDesk box, you agree to these terms on behalf of the business you run (“you”). You confirm you are at least 18 and allowed to bind that business.
TableDesk is for businesses only. You use it for your trade, not as a consumer, and consumer protection rules do not apply to this agreement as far as the law allows. If you are a guest ordering from a venue’s menu, the venue’s own terms apply to you, not these.
How we handle personal data is set out in our privacy policy, which is part of this agreement. For data your venue puts into TableDesk, we act as your processor under it.
2. Accounts and staff
- Keep your account details correct, and your password, your staff’s PINs and your box’s recovery key safe. Everything done under your account, or by anyone you gave access, is your responsibility.
- You decide who on your staff can do what. Every void, discount and approval is recorded with the name of the person who made it.
- Tell us at once at support@tabledesk.app if you think someone has got into your account. You can sign out any device, and revoke a lost or stolen one, from the app.
3. Plans and prices
Our plans and their prices are on our pricing page. Prices are in US dollars and do not include tax, which is added where the law requires it. They are charged per place: each venue location has its own plan.
- Starter includes up to 5 screens per place. Pro includes 20, and you can add packs of 10 more. A screen is a paired till, kitchen screen, tablet or kiosk, or a staff member’s phone while they are signed in. Guests’ phones never count.
- Self-hosted and Offline are yearly licences for a box in your venue, with no screen limit.
- If we change a price, we tell you by email at least 30 days before your next renewal at the new price. You can cancel before then.
4. The free month
Starter and Pro start with a free first month. We ask for a card when you start it, and charge nothing during the month. If you do not cancel before it ends, your first payment is taken on the day it ends and your plan carries on. You can cancel during the month and pay nothing. One free month per business.
5. Billing, cancelling and refunds
- Monthly plans are charged at the start of each month and can be cancelled at any time. You keep the service until the end of the month you paid for.
- Yearly plans are paid up front for the year, which is why they cost less. They can be cancelled at any time and run to the end of the year you paid for.
- Moving up, from Starter to Pro or adding screen packs, starts at once and is charged now for the rest of the period you are in. Going yearly starts a new year that day, with the whole new plan, charged for the year less what is left of the month already paid. Moving down, to monthly or removing packs, starts at your next renewal, and nothing is paid back for the period you are in.
- Archiving a place ends its plan at the end of the period you paid for.
- Payments are not refunded, including for the unused part of a month or a year, except where the law gives you that right.
- Payments are taken by Stripe. Plans, cards and invoices are managed on the web, from your account’s Plan & billing; the TableDesk apps in the App Store and Google Play sell nothing.
6. When a payment fails
- We email the account’s owners and try the card again over the next 14 days. Updating the card in Plan & billing settles it at once.
- If it is still unpaid after 14 days, the place it is for becomes read-only: you can still sign in, see everything, run reports and export all your data, but no new business day opens there until the payment is made.
- We never stop a shift that is already running. A business day open when the 14 days end runs to its close as usual.
- Paying brings everything back at once, with nothing lost. An account left unpaid for a long time can be ended under section 14.
7. Box licences
A Self-hosted or Offline box comes with a licence for a year, which we sign and the box checks itself. The box is installed and set up together with us.
- We remind you 30 days before your licence ends. After the end date there are 14 more days in which everything keeps working.
- After that, the box opens no new business day and takes no update until a new licence is loaded. A day already open always runs to its close.
- Even then, you can still read everything, run reports, export your data, take and restore backups.
- The box is in your building and in your care: its power, its network, its physical safety and its backup disk. Its backups are encrypted with a recovery key only you hold. If you lose the recovery key, nobody can recover the box’s backups, us included.
8. What you are responsible for
TableDesk is a tool. You run your business with it, and you stay responsible for your business. In particular:
- Tax and fiscal duties. TableDesk records how each bill was paid. It does not process payments, it is not a fiscal device, and it takes no cut of your sales. Registering your fiscal devices, issuing fiscal receipts, charging the right VAT, filing your returns and keeping records for as long as the law requires are yours. TableDesk can send receipts to your certified fiscal printer and keeps an audit trail; it does not replace your accountant.
- What your menu says. Prices, descriptions, allergens, ingredients, translations and anything else you or your staff enter are your content. Check it is correct; guests rely on it.
- Age checks and the law on alcohol. TableDesk can hide drinks until a staff member confirms a guest’s age; making the check, and serving responsibly, are your staff’s.
- Your staff and guests’ data. You need a lawful reason to record your staff’s and guests’ details, including timesheets and photos, and you must tell them what you record. For that data you are the controller.
- Your equipment and connection. Phones, tablets, TVs, printers, card terminals, routers, power and the internet are yours to choose, keep working and keep secure.
- Your own copies. Export your data and keep your own copy regularly, especially reports and records the law makes you keep.
- Your staff’s conduct while using TableDesk, and anything done with a PIN you gave them.
9. Your data
- Your data is yours. Your menu, orders, staff, guests and reports belong to you. You can download all of it at any time.
- You give us the right to store and process it only to run TableDesk for you, as our privacy policy describes. We do not sell it or use it for advertising.
- When you leave, you can take your data with you. After an organization is deleted we keep it for 30 days in case it was a mistake, then delete it, and it leaves our backups as they expire.
10. Fair use
Please don’t:
- break the law with TableDesk, or use it to record anything you have no right to record;
- try to get into other venues’ data, or into parts of our systems that are not yours;
- overload, probe or attack the service, or get around its limits;
- copy, resell or take apart the software, except where the law allows it.
11. The service
- We work to keep TableDesk running at all hours a venue might be open, and to update it with as short an interruption as we can. We do not promise it will never be down or never have a fault: networks, providers and hardware fail. No uptime level is promised unless we agree one with you in writing.
- Devices keep taking orders when the internet drops, as described on our website. A cloud venue needs the internet for its devices to see each other’s orders; a Self-hosted or Offline box does not.
- We improve TableDesk all the time. We may change or remove a feature, but we will not take away something central to your plan during the period you have paid for.
- A feature we mark as early or preview is offered as it is, and may change or go away.
- Pro includes support by email. We answer as soon as we reasonably can; no response time is promised unless we agree one with you in writing.
12. Other companies’ services
TableDesk works with services we do not run: Stripe for payments, Google and Apple for sign-in and notifications, Cloudflare, the app stores, email delivery, and the printers, card terminals and delivery platforms you use alongside it. Their own terms apply to them. We are not responsible for what they do, for them being unavailable, or for changes they make.
13. Suspension
We may suspend access, in whole or in part, if it is needed to protect TableDesk, other venues or anyone’s data; if the law or an authority requires it; if you seriously break these terms; or as section 6 describes for an unpaid account. Where we can, we tell you first and give you a chance to fix it, and we lift the suspension as soon as the reason is gone. A suspension for these reasons is not a breach of this agreement by us.
14. Ending the agreement
- You can stop at any time: cancel your plan from Plan & billing, and close your account from your account settings.
- We may end the agreement if you seriously or repeatedly break these terms, or leave an account unpaid. Except where it is urgent, we give you notice and time to export your data.
- A cloud organization that never took an order is deleted once it has not been used for a year, after we have emailed its owners twice, or when its last owner closes their account. One that has taken orders is never deleted unless an owner deletes it.
- Sections 8, 15, 16, 17, 19 and 20 still apply after the agreement ends.
15. No promises beyond these terms
Apart from what these terms say, TableDesk is provided “as is” and “as available”. As far as the law allows, we make no other promises, stated or implied, including that it will suit a particular purpose, be free of errors, or never lose or change data.
16. Limits on our liability
Nothing in these terms limits or excludes liability that the law does not allow to be limited or excluded, such as for fraud, for harm done on purpose or through gross negligence, or for death or injury caused by negligence.
Apart from that, and as far as the law allows:
- we are not liable for lost profits, lost sales, lost revenue, lost business or goodwill, or for any indirect or consequential loss;
- we are not liable for loss or corruption of data, or for fines, penalties or tax you owe, except where it is caused by our breach of these terms, and then only within the cap below;
- we are not liable for anything that follows from the matters in section 8, from other companies’ services in section 12, or from events in section 18;
- our total liability to you for everything arising from this agreement in any 12 months is limited to what you paid us in the 12 months before the event that gave rise to the claim;
- a claim must be made within one year of when you knew, or should have known, about it.
17. Claims against us caused by you
If someone, such as your staff, a guest, a tax or other authority, or another business, makes a claim against us because of your use of TableDesk, your content, your breach of these terms or of the law, you will cover our reasonable costs and losses from that claim, including legal fees. We will tell you about the claim promptly and let you take part in handling it.
18. Events outside our control
We are not responsible for failing or being late to do something because of events we cannot reasonably control, such as power or internet failures, failures of other companies’ services, attacks on our systems, natural disasters, war, strikes, epidemics or actions of authorities.
19. Disputes
If something goes wrong, please write to us first; most problems are fixed faster that way.
20. General
- These terms, the privacy policy and anything we agree with you in writing are the whole agreement between us about TableDesk.
- If a court finds part of these terms invalid, the rest still applies, and the invalid part is read as closely to its purpose as the law allows.
- If we don’t enforce a right at once, we have not given it up.
- You may not transfer this agreement without our written agreement. We may transfer it to a company that takes over TableDesk, and will tell you if we do.
- We send notices to the email address on your account. You send them to support@tabledesk.app.
21. Changes to these terms
If we change these terms, we update the date at the top and email account owners at least 30 days before a change that matters takes effect. If you don’t agree, you can cancel before then. Using TableDesk after the change means you accept it.
